1. Introduction
These Terms and Conditions govern the sale of software and hardware products by Futuretech Consulting (“Company”, “we”, “us”, or “our”) to our customers (“Customer”, “you”, or “your”). By placing an order with us, you agree to these Terms and Conditions.

2. Orders and Acceptance
2.1 All orders placed by the Customer are subject to acceptance by Futuretech Consulting.
2.2 We reserve the right to reject any order for any reason.
2.3 Order acceptance occurs when we issue an order confirmation or deliver the product to the Customer.

3. Pricing and Payment
3.1 All prices are quoted in New Zealand Dollars and are exclusive of applicable taxes, duties, and shipping costs.
3.2 Payment terms will be as specified in the invoice. Failure to pay within the agreed timeframe may result in suspension of delivery or legal action. The Customer is liable to pay any costs associated with the collection of the outstanding amount owed.
3.3 We accept payment via Bank Transfer, Cash, Visa or Master Card.

 

4. Delivery and Shipping
4.1 Delivery times are estimates and not guaranteed.
4.2 The risk of loss or damage to hardware products passes to the Customer upon shipment.
4.3 The Customer is responsible for any import duties or taxes applicable to international shipments.

 

5. Software Licensing
5.1 Software provided by Futuretech Consulting is licensed as in the terms and conditions of the supplier.
5.2 The Customer is granted a non-exclusive, non-transferable license to use the software per the accompanying license agreement.
5.3 Unauthorized reproduction, distribution, or modification of the software is prohibited.

5.4 Any software licensing cancellations whether Cloud Based or locally installed must be done within 90 days of renewal, if you do not notify us within the timeframe then you are liable to pay remainder of the term of the software provided.

 

6. Warranties
6.1 Hardware products are covered by a limited warranty as specified in the product documentation.
6.2 Software is provided “as is” unless stated otherwise in a separate agreement.
6.3 The warranty does not cover damage caused by misuse, unauthorized modifications, or external factors beyond our control.

 

7. Returns and Refunds
7.1 Returns for defective hardware must be requested within 7 days of receipt.
7.2 Refunds or replacements will be issued at our discretion after inspection of the returned product.
7.3 Software purchases are non-refundable unless otherwise stated.

 

8. Limitation of Liability
8.1 Futuretech Consulting is not liable for any indirect, incidental, or consequential damages arising from the use of our products.
8.2 Our total liability is limited to the amount paid by the Customer for the specific product in question.

 

9. Intellectual Property
9.1 All software, trademarks, and other intellectual property rights remain the property of Futuretech Consulting or its licensors.
9.2 The Customer may not copy, modify, or distribute our software without prior written consent.

 

10. Governing Law and Dispute Resolution
10.1 These Terms and Conditions are governed by the laws of New Zealand.
10.2 Any disputes shall be resolved through arbitration or courts located in New Zealand.

 

11. Amendments and Updates
11.1 We reserve the right to modify these Terms and Conditions at any time. Updates will be posted on our website.
11.2 Continued use of our products or services after updates constitutes acceptance of the revised terms.

 

12. Domain Hosting

12.1 Any domains hosted by our suppliers are managed by FTC.

12.2 For any hosted domain invoices that remain unpaid, we can either put your domain on hold, suspend some or all services until any outstanding invoices are paid for in full or put your domain on the market for resale to recover the debt. We also reserve the right to hand over any unpaid invoices to  a debt recovery agent for the recovery of the outstanding amount including any associated costs for the recovery of the debt. 

12.3 For any domains that need to be cancelled, please provide 30-days notice before expiration, as we cannot cancel anytime after the 30-day notice period.

 

13. Charge out Rates

13.1 On-site consultation is charged $185.00 per/hour excl GST. For jobs that exceed 5 hrs for work requested, we may offer a lower rate.

13.2 Remote consultation is charged out rate is $135.00 per/hour excl GST. For jobs that exceed 5 hrs for work requested, we may offer a lower rate.

13.3 Pensioners and non-profit organisations is charged out at $90.00 per/hour excl GST. For jobs that exceed 5 hrs for work requested, we may offer a lower rate.
